What belongs in the final settlement

When the employment relationship ends, all claims fall due (Art. 339 para. 1 CO). These include the salary up to the last day, the pro rata share of the 13th-month salary, holidays not taken, overtime worked and outstanding expenses. The employer may deduct only what is provided for by law or contract. Holidays may not be replaced by money during the employment relationship (Art. 329d para. 2 CO). On leaving, they are paid out if they can no longer be taken.

Typical mistakes

Holiday days are forgotten or offset against garden leave even though the garden leave was too short. Overtime is compensated without the statutory 25 per cent supplement even though the contract does not exclude it. The 13th-month salary is not paid pro rata. A bonus is cancelled even though it was part of the salary. Deductions for training, damages or advances are too high or were not agreed.

What does the check cost?+

CHF 190 for a gross monthly salary of up to CHF 5'500. For each additional CHF 500 of monthly salary or part thereof, CHF 30 is added. At CHF 8'000 it is CHF 340, at CHF 10'000 CHF 460. Incl. VAT, flat fee.

How long do I have to assert claims?+

Salary claims become time-barred after five years (Art. 128 no. 3 CO). Nevertheless, act quickly: a written letter shortly after leaving is most effective.

I am an employer. Is this useful to me?+

Yes. A checked final settlement protects against additional claims, conciliation proceedings and default interest. You receive a sign-off or specific corrections before you pay out.

What if the employer does not pay?+

Then you can order the conciliation request. We prepare it ready to file. Proceedings before the conciliation authority are free of charge up to an amount in dispute of CHF 30'000.
